Luxury Photoshoot Experience — Cappadocia

1. General Agreement

By booking a photoshoot (via message, verbal confirmation, or payment), the Client fully accepts these Terms of Service.

This agreement is legally binding and applies to all services provided by the Photographer.

2. Artistic Vision & Service Format

The Client acknowledges that they are booking a creative luxury photography experience, based on the Photographer’s unique artistic style, vision, and direction.

The Photographer retains full control over:
– artistic direction
– shooting style
– editing and color grading
– final selection of delivered materials

3. Copyright & Ownership

All photo and video materials created during the photoshoot are the exclusive intellectual property of the Photographer.

The Photographer retains full, irrevocable, worldwide copyright ownership of all created content.

The Client receives a non-exclusive, non-transferable license for personal use only.

Commercial use is strictly prohibited without prior written consent.

4. Publication & Usage Rights

By booking a photoshoot, the Client grants the Photographer the unrestricted, perpetual, worldwide right to use all visual materials.

This includes:
– social media
– website and portfolio
– advertising and marketing
– publications (digital and print)
– third-party platforms and collaborations

No further consent is required for such use.

5. MODEL RELEASE (CONSENT TO USE IMAGE)

By participating in the photoshoot, the Client (and any accompanying persons) hereby grants the Photographer:

– the irrevocable and unrestricted right to use their image, likeness, appearance, and voice
– permission to capture, edit, modify, reproduce, publish, and distribute such materials
– the right to use the content for commercial, promotional, advertising, and portfolio purposes

The Client expressly waives:
– any right to inspect or approve the final materials
– any right to compensation related to the use of the materials
– any claims regarding defamation, privacy, or publicity rights

This consent is granted:
– without time limitation
– worldwide
– without requirement of additional approval

The Photographer is not obligated to identify or tag the Client.

6. Privacy & Opt-Out Policy

If the Client does not wish to appear in published materials, they must inform the Photographer in writing before the photoshoot.

Such requests:
– require prior approval
– may involve an additional privacy (buyout) fee
– may result in refusal of service

Requests made after the photoshoot are not guaranteed to be accepted.

7. Payment Terms

Standard booking requires an advance payment.

However, flexible conditions may be offered at the Photographer’s discretion.

All additional services require full prepayment.

Photoshoot payment is made in cash on the day, unless otherwise agreed.

8. Rescheduling & Force Majeure

Photoshoots depend on weather conditions.

– Rescheduling is subject to availability
– Rain or unsafe conditions may require changes
– Hot air balloons are not guaranteed and are not grounds for cancellation or refund

9. Liability Disclaimer

The Photographer is not responsible for:
– weather conditions
– third-party service cancellations
– external delays or restrictions

10. Acceptance of Terms

By booking a photoshoot, the Client confirms that:
– they have read and understood all terms
– they fully agree with these conditions
– they grant full rights as described above

These terms are designed to maintain a high-end, professional experience while protecting both creative integrity and business operations.
